1. Acceptance of Terms

By accessing or using the INSAIDR platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and INSAIDR ("we," "our," or "us").

2. Service Description

INSAIDR is a Software-as-a-Service (SaaS) platform that provides LinkedIn outreach automation, AI-powered message personalization, campaign management, intent detection, and pipeline management tools. The Service is designed to help sales teams, marketing agencies, and consultants automate and optimize their LinkedIn prospecting and outreach activities.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Comply with LinkedIn's Terms of Service and User Agreement when using our platform to interact with LinkedIn
• Ensure that your use of automation features does not violate LinkedIn's policies or any applicable laws

You acknowledge that your LinkedIn account is subject to LinkedIn's own terms, and you are solely responsible for ensuring your activities comply with those terms.

4. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk messages (spam) or engage in any form of abusive messaging
• Exceed recommended daily sending limits or circumvent rate-limiting safeguards built into the platform
• Scrape, harvest, or collect data from LinkedIn beyond what is authorized through your use of the Service
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Distribute malware, viruses, or any other harmful code
• Use the Service in any way that violates applicable local, national, or international law
• Attempt to gain unauthorized access to the Service, other user accounts, or related systems

We reserve the right to suspend or terminate accounts that violate these acceptable use guidelines without prior notice.

5. Intellectual Property

The Service, including its design, features, code, documentation, logos, and content, is owned by INSAIDR and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.

You retain ownership of all content you create, upload, or generate through the Service, including campaign configurations, message templates, and contact data. You grant us a limited license to process this content solely for the purpose of providing the Service.

6. Payment Terms

Access to the Service requires an active paid subscription, except for any free trial period we may offer. By subscribing, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select
• Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date
• Cancellations take effect at the end of the current billing period; no partial refunds are provided for unused time
• We may change subscription pricing with at least 30 days' notice before the change takes effect
• Failed payments may result in suspension of your account until the outstanding balance is resolved

7. Limitation of Liability

To the maximum extent permitted by applicable law, INSAIDR and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, business, or goodwill
• LinkedIn account restrictions, suspensions, or bans
• Service interruptions or downtime
• Errors or inaccuracies in AI-generated content

Our total liability to you for any claims arising from or related to the Service shall not exceed the total amount paid by you to INSAIDR during the twelve (12) months preceding the claim.

8. LinkedIn Compliance

INSAIDR is designed with safety mechanisms to help protect your LinkedIn account. These include human-like sending patterns, daily sending limits, smart throttling, and activity randomization. We follow LinkedIn's published rate limits and best practices for automation.

However, you acknowledge and agree that:

• You are solely responsible for your LinkedIn account and any actions taken through it via our Service
• LinkedIn may change its policies, rate limits, or enforcement practices at any time without notice
• We do not guarantee that your LinkedIn account will not be restricted or suspended as a result of using the Service
• You should review and configure sending limits in accordance with your account's standing and LinkedIn's current guidelines

9. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting our support team. We may terminate or suspend your access to the Service immediately, without prior notice, if we reasonably believe that:

• You have violated these Terms or our Acceptable Use policy
• Your use poses a security risk to the Service or other users
• Your account has been flagged for fraudulent activity or abuse
• Continued provision of the Service is no longer commercially viable

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which INSAIDR operates, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction. You agree to submit to the personal jurisdiction of such courts.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
